1. Acceptance of Terms

By placing an order for dumpster rental services, whether by phone, online, or in person, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service. If you do not agree to these Terms, you may not use our services.

2. Service Description

My Dumpster Service LLC provides roll-off dumpster rental services for residential, commercial, and construction purposes in Lakeland, FL, and surrounding Polk County areas. Our services include:

• Delivery of dumpsters in various sizes (10, 15, 20, and 30-yard containers)
• Rental period as specified in your rental agreement
• Pickup and proper disposal of waste materials
• Customer support throughout the rental period

3. Rental Agreement and Pricing

3.1 Rental Period

The standard rental period is 7-14 days from the date of delivery, unless otherwise specified in your rental agreement. Extensions are available upon request and may incur additional charges.

3.2 Pricing

All pricing is provided in your initial quote and includes:

• Dumpster delivery
• Rental period (as specified)
• Weight allowance (as specified for your dumpster size)
• Pickup and disposal

3.3 Additional Fees

Additional charges may apply for:

• Rental period extensions beyond the agreed-upon timeframe
• Weight overages beyond the included weight limit
• Prohibited materials requiring special disposal
• Failed delivery or pickup attempts due to blocked access or unprepared sites
• Delivery outside our standard service area
• Permits required for street placement (if applicable)

3.4 Payment Terms

Payment is due at the time of service unless commercial credit terms have been established. We accept cash, check, and all major credit cards. For commercial accounts, payment terms are Net 15 days unless otherwise agreed upon in writing.

4. Customer Responsibilities

4.1 Site Preparation

Customer is responsible for:

• Ensuring a clear, level, and accessible area for dumpster placement
• Removing vehicles, equipment, and obstacles from the delivery area
• Providing at least 60 feet of straight-line access and 23 feet of vertical clearance
• Identifying and marking underground utilities, septic systems, or other buried infrastructure
• Obtaining any necessary permits for street placement

4.2 Proper Use

Customer agrees to:

• Use the dumpster only for its intended purpose
• Not overload the dumpster above the top edge/sidewalls
• Not exceed the weight limit specified for the rented dumpster size
• Only dispose of acceptable materials as outlined in Section 5
• Not move the dumpster once placed
• Keep the dumpster accessible for pickup
• Secure the dumpster from unauthorized use by third parties

4.3 Property Protection

While we take reasonable precautions to protect your property, the Customer is responsible for ensuring the surface where the dumpster is placed can support its weight when full. Customer should inform us of any concerns about driveways, pavement, or surface conditions.

5. Acceptable and Prohibited Materials

5.1 Acceptable Materials

Our dumpsters accept the following materials:

• Household junk and furniture
• Construction and demolition debris (wood, drywall, flooring)
• Roofing materials and shingles
• Appliances (refrigerators require special handling notification)
• Yard waste (branches, leaves, sod, dirt)
• Concrete, brick, and asphalt (must be separate loads and may incur additional charges)
• Carpeting and padding
• Cabinets and countertops
• Windows and doors

5.2 Prohibited Materials

• Hazardous Waste: Paint, solvents, chemicals, pesticides, herbicides, oil, gasoline, antifreeze
• Automotive: Car batteries, tires, motor oil
• Electronics: Televisions, computers, monitors (e-waste)
• Appliances with Freon: Refrigerators and air conditioners (unless properly drained and notified in advance)
• Propane Tanks and Gas Cylinders
• Medical Waste: Needles, syringes, infectious materials
• Asbestos Materials
• Dead Animals
• Radioactive Materials
• Explosives or Flammable Materials

5.3 Penalties for Prohibited Materials

If prohibited materials are found in the dumpster, Customer will be charged for:

• Special disposal fees (which can range from $100 to $500+ depending on the material)
• Additional labor and transportation costs
• Any fines or penalties imposed by disposal facilities
• Any environmental cleanup costs if contamination occurs

Customer may also be held liable for any environmental damage or regulatory violations resulting from disposal of prohibited materials.

6. Delivery and Pickup

6.1 Delivery

We will deliver your dumpster on the scheduled date within the agreed-upon timeframe. Same-day delivery is available when orders are placed before 10 AM, subject to availability. We will notify you when the driver is en route.

6.2 Placement

Dumpsters will be placed in the location specified by the Customer, provided it is safe and accessible. Final placement decisions rest with the driver for safety reasons. We are not responsible for damage to surfaces that cannot support the weight of a loaded dumpster.

6.3 Pickup

Customer must call or text to schedule pickup when the dumpster is ready for removal. The dumpster must be accessible, with no vehicles or obstacles blocking access. Materials must not exceed the top of the dumpster sidewalls.

6.4 Failed Pickup/Delivery

A trip fee of $75-$150 may be charged if we are unable to deliver or pickup the dumpster due to:

• Blocked or inaccessible placement area
• Customer unavailability when coordination was required
• Overfilled dumpster that cannot be safely transported
• Incorrect address or directions provided

7. Weight Limits and Overages

Each dumpster size has a specified weight limit included in the rental price:

• 10-yard dumpster: 2 tons (4,000 lbs)
• 15-yard dumpster: 3 tons (6,000 lbs)
• 20-yard dumpster: 4 tons (8,000 lbs)
• 30-yard dumpster: 5 tons (10,000 lbs)

Weight overage charges apply at a rate of $75-$100 per ton over the included weight limit. Heavy materials such as concrete, brick, dirt, and roofing materials can quickly exceed weight limits even in partially filled dumpsters.

8. Rental Period and Extensions

The standard rental period is 7-14 days. If you need the dumpster longer, contact us before the end of your rental period to arrange an extension. Extension fees are typically $10-$15 per day. Dumpsters not picked up due to Customer failure to schedule pickup may incur daily rental fees.

9. Cancellation Policy

Cancellations made at least 24 hours before scheduled delivery will receive a full refund. Cancellations made less than 24 hours before delivery or after delivery has occurred may incur a cancellation fee of up to 50% of the rental cost to cover administrative and transportation expenses.

10. Liability and Insurance

10.1 Company Liability

My Dumpster Service LLC maintains appropriate insurance coverage for our operations. However, we are not liable for:

• Damage to surfaces that cannot support the weight of the dumpster
• Damage to underground utilities, septic systems, or irrigation systems not marked by Customer
• Damage caused by Customer misuse of the dumpster
• Theft or unauthorized use of the dumpster by third parties
• Property damage from overfilled dumpsters that shift during transport
• Low-hanging wires, tree branches, or other obstacles that interfere with delivery/pickup

10.2 Customer Liability

Customer is liable for:

• All damages to the dumpster during the rental period
• Fines or penalties resulting from prohibited materials
• Costs associated with improperly loaded or overfilled dumpsters
• Damage to our equipment caused by Customer negligence
• Any theft of the dumpster or its contents from the Customer's property

10.3 Indemnification

Customer agrees to indemnify and hold harmless My Dumpster Service LLC, its owners, employees, and agents from any claims, damages, losses, or expenses arising from Customer's use of the dumpster or violation of these Terms.

11. Permits and Regulations

Customer is responsible for obtaining any necessary permits for dumpster placement on public property or right-of-way. In Lakeland, Florida, permits are typically required when placing dumpsters on public streets. Contact the City of Lakeland Engineering Department at (863) 834-6070 for permit information.

Customer must comply with all local, state, and federal regulations regarding waste disposal. We reserve the right to refuse service if we believe a request violates applicable laws or regulations.

12. Ownership and Title

All dumpsters remain the property of My Dumpster Service LLC at all times. Customer is renting the dumpster and has no ownership rights. Customer may not sell, sublease, or transfer the dumpster to any third party.

13. Service Area

Our primary service area includes Lakeland, Florida, and surrounding Polk County communities. Deliveries outside our standard service area may be accommodated with additional distance fees. Service availability is subject to our discretion based on distance, road conditions, and operational capacity.

14. Disputes and Resolution

We are committed to customer satisfaction and will work to resolve any disputes amicably. If you have concerns about our service, please contact us immediately at (863) 412-5036. Most issues can be resolved through open communication.

Any disputes that cannot be resolved through negotiation shall be subject to the laws of the State of Florida and the jurisdiction of Polk County courts.

15. Modifications to Terms

My Dumpster Service LLC reserves the right to modify these Terms of Service at any time. Updated Terms will be posted on our website with a revised "Last Updated" date. Continued use of our services after modifications constitutes acceptance of the updated Terms.

16. Privacy

We respect your privacy and handle your personal information in accordance with applicable privacy laws. We collect only the information necessary to provide our services, including name, address, phone number, and payment information. We do not sell or share your information with third parties except as necessary to fulfill our services (e.g., disposal facilities, payment processors).

17. Force Majeure

My Dumpster Service LLC is not liable for delays or failures in performance resulting from acts beyond our reasonable control, including but not limited to: natural disasters, severe weather, acts of God, government actions, labor disputes, equipment failures, or other circumstances beyond our control.

18. Entire Agreement

These Terms of Service, along with your rental agreement and any additional terms communicated at the time of rental, constitute the entire agreement between Customer and My Dumpster Service LLC. These Terms supersede any prior agreements or understandings, whether written or oral.

19. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
